These Terms of Service (“Terms”) govern your use of The Agency Toolkit (“Service”), operated by Code & Beans AB (Org. no. 556772-5196), Västanäsgatan 6, 94234 Älvsbyn, Sweden (“we”, “us”, or “our”). By using or accessing theagencytoolkit.com, app.theagencytoolkit.com, or any related services, you agree to these Terms.
1. Eligibility
The Service is intended for business users, agencies, and individuals. You must register an account to use the Service. There are no age restrictions, but this Service is not intended for children.
2. Account Registration
To access the Service, you must create an account using your name and email address. To begin a free trial or paid subscription, you must also provide payment details via our payment processor (Stripe). You are responsible for safeguarding your account and any activities occurring under your credentials.
3. Subscription, Billing, and Payment
The Service is offered on a subscription basis. All billing and payments are processed securely via Stripe. The current plan is $97/month. You can cancel your subscription at any time through your account or by contacting support. All fees are non-refundable except as required by law.
4. Content Ownership
Any websites, content, or materials generated by The Agency Toolkit are owned by the registered user (agency/client). Code & Beans AB claims no ownership over generated content. You are solely responsible for the use, publication, and compliance of such content.
5. Data Collection and Privacy
To provide the Service, we may collect and store business and client information such as addresses, phone numbers, emails, and other details imported from your HighLevel sub-accounts. Your data will be handled in accordance with our Privacy Policy.
6. Use of Artificial Intelligence
The Service uses AI to generate website content. You acknowledge that AI-generated content may not always be accurate, error-free, or legally compliant. You are responsible for reviewing, editing, and ensuring all content complies with applicable laws and regulations before using or publishing it.
7. Support
We provide email support for all users. We aim to respond within 24–48 hours on business days.
8. Acceptable Use Policy
You agree not to use the Service for any unlawful, harmful, or abusive purpose. Prohibited activities include, but are not limited to:
- Spamming, phishing, or distributing malware
- Infringing on intellectual property rights
- Violating privacy or data protection laws
- Using the Service to create illegal, fraudulent, or misleading content
Attempting to gain unauthorized access to the Service or interfere with its security or operation
9. Limitation of Liability
To the maximum extent permitted by law, Code & Beans AB and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability shall not exceed the fees paid by you for the Service during the twelve (12) months preceding the claim.
10. Jurisdiction and Governing Law
These Terms are governed by and construed in accordance with the laws of Sweden. Any disputes arising from these Terms or the use of the Service will be subject to the exclusive jurisdiction of Swedish courts.
11. Termination
We reserve the right to suspend or terminate your access to the Service, at our discretion, if we believe you are misusing the Service or using it outside its intended purpose.
12. Modifications to Service and Terms
We may modify these Terms or the Service at any time. Significant changes will be communicated via email or through the Service. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.
